其实与很多用法律经济分析作为对抗某种法教义学的观点不同，我更认为法律经济分析是法教义学价值判断上不可缺少的一部分。因为传统的解释学方法很难去论证与衡量效率这一重要价值，同时如果将法律经济分析过分独立，则会陷入实质上只有效率唯一价值的尴尬境地（法经济学上的公平等其他价值或者由效率阐发，或者是法经济学上的无源之水）。同时在法律适用中，法经济学有多大的威力，他就有多大的局限，而把它放在大的法教义学框架下…
想要建构透彻的结构需要多读几遍，但是波斯纳写书是真的幼儿园老师级别的细致，手把手给你举例子讲概念——以至于我之前担心看不懂找来的国内版发现删了不少例证。（但国内版翻译很烂，看中文能反想英文级别的机翻，别看。英文是真的写很好。
